Here at Hudson Banks, we are aware of the value of your privacy and are firmly committed to protecting it.

This policy outlines when and why we collect personal information about you, how that information is used, the conditions under which it may be provided to third-parties, our legal justification for processing your information and the necessary steps we take under data protection law to secure it.

Throughout this policy, the terms “Hudson Banks”, “we”, “our”, or “us” refer to HBANS Ltd.

This Privacy Policy applies to information obtained by us through your use of the Hudson Banks website or services or any information provided to us by a third party. Who are we?

HBANS Ltd t/a Hudson Banks is a specialist recruitment boutique which services the Public Practice and Commerce & Industries arenas. We are a registered company (no. 09078720). The registered address is Unit A6, Lakeside Business Park, Cirencester, England, GL7 5XL. As a recruitment business, we provide work-finding services to our clients and work-seekers. We must process personal data to provide these services – and in doing so, Hudson Banks acts as a Data Controller.

Collection and Use of Personal Data

We routinely collect a variety personal information about our candidates in the course of business and rely on this data in order to provide our work-finding services. We may collect the following types of personal data:

  • Name, address and date of birth;
  • Contact details, including e-mail address and telephone number(s);
  • Details of academic and professional qualifications, skills, employment history (including duration), salary, experience and prior interactions with Hudson Banks;
  • Special category data, such as ethnicity, health or disability in order to provide this information to a client in the course of the application process with your consent;
  • Details of your entitlement to work in the UK;

Hudson Banks will collect and retain your personal information (excluding special category data) on the legal basis of legitimate interests. This basis is applied where we have a legitimate reason to process your data provided it is understandable, fair and does not go against what you might reasonably expect from us.

Where we have relied on legitimate interests to process your personal data, our legitimate interests are as follows:

  • Management and updating of our database to ensure we keep work-seeker records up to date and accurate;
  • Providing work-seekers with the appropriate work-finding services should it be needed;
  • Contacting you to seek your consent where necessary;
  • Maintenance of a relationship in order to provide you with work-finding services when appropriate;

In the case of processing special category data, we will always rely on your explicit consent before storing this data or providing it to any of the third-parties mentioned below. We do not knowingly solicit information from children and we do not knowingly market our services to children.

You can visit our website without telling us who you are or revealing any information about yourself, including your email address. In this case, our web server may collect the name, address, the IP address and domain you used to access this Site, the type and version of browser and operating system you are using, and the web Site you came from and visit next. This information is used by us and our business partners to measure the number of visits, average time spent, page views, and other statistics about visitors to this Site in general. We may also use this data to monitor Site performance for systems administration purposes, to make this Site easier and more convenient to use and to report information in aggregate form to our advisers (e.g. how many visitors log in to this Site).

Cookies

The only third parties we will share your information with are those we work with during the work-finding process; generally, this means the clients and employers with which we have a relationship. Personally identifiable information will only be sent to third parties with your consent. Information transmitted to third parties then falls under the privacy policy of that third party and is no longer under the remit of our Policy.

This Site may contain links to other Sites, including those of our business partners, vendors and advertisers. While we try to link only to Sites that share our high standards and respect for privacy, please understand that we are not responsible for the content of, or the privacy practices employed by, other Sites.

Data Retention

Hudson Banks will retain your personal data only for as long as is necessary. Different laws and statutory regulations require us to hold information for different periods of time. We regularly review our retention periods to remain in-line with data minimisation principles.

The Conduct of Employment Agencies and Employment Businesses Regulations 2003, require us to keep work-seeker records for at least one year from (a) the date of their creation or (b) after the date on which we last provide you with work-finding services.

We must also keep your payroll records, holiday pay, sick pay and pension auto-enrolment records for as long as is legally required by HMRC and associated national minimum wage, social security and tax legislation.

Where we have obtained your consent to process your personal information, we will do so in line with our retention policy. Upon expiry of that period we will seek further consent from you. Where consent is not granted Hudson Banks will cease to process your personal data.

Your Rights

The European General Data Protection Regulations (“GDPR”) have enhanced the rights of the data subject in regards to their ability to interact with their data. Specifically, the GDPR bestows the following rights on you:

  • The right to be informed about the personal data we process on you;
  • The right of access to the personal data we process on you;
  • The right to rectification of your personal data;
  • The right to erasure of your personal data in certain circumstances;
  • The right to restrict processing of your personal data;
  • The right to data portability in certain circumstances;
  • The right to object to the processing of your personal data that was based on a public or legitimate interest;
  • The right not to be subjected to automated decision making and profiling; and
  • The right to withdraw consent at any time.

CVs Uploaded via the Website

As part of the services Hudson Banks provides, you are able to post your CV on our website. This section of Hudson Banks’ general Privacy Policy applies to the use of your CV by Hudson Banks.

CVs are accessed by our consultants who seek to find you employment with third parties. Consultants are not permitted to disclose information outside our organization or beyond the third party, as applicable. Recruiters are also required to have entered into an agreement with third parties that requires such third parties to use your CV solely for the purpose of filling a job within the third party for which the information was provided and not disclosing your CV outside the organization. However, although Hudson Banks deals only with reputable organizations, we cannot guarantee that all Employers and Third Parties will adhere to the limitations we impose on them. Although we use all reasonable means to protect your personal information, Hudson Banks is not responsible for any improper use of your personal information that is beyond our reasonable control.

Your CV when uploaded is converted in to various formats for our use only. These conversions are handled by an external datacentre server stack. Once conversion is complete your CV is then automatically deleted from that service. We are committed to ensuring that your information is secure. In order to prevent unauthorized access or disclosure, the data company have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information. We may disclose your information if necessary to protect our legal rights or if the information relates to actual or threatened harmful conduct or potential threats to the physical safety of any person. Disclosure may be required by law or if we receive legal process. If these servers are breached we are not responsible for this and cannot be held liable.

Protection of Personal Data

Where Hudson Banks considers it appropriate, Hudson Banks uses encryption and/or authentication tools among other methods to protect certain web-based personal information. E-mails you send us are not necessarily secure when they are transmitted to us. If your communication is sensitive or includes confidential information, you may want to provide it by post or via the telephone instead.

We instruct our employees with access to your personal information that it is to be used only in adherence with the principles set forth in this Privacy Policy and the laws applicable to each specific business. Employees who misuse customer personal information may be subject to disciplinary action.

Hudson Banks reserves the right to modify or supplement this Privacy Policy statement at any time.
